Official Rules McCann’s Irish Oatmeal Body & Soul Sweepstakes
No Purchase or Payment of Any Kind is Necessary To Enter or Win.
1. To Enter: Sweepstakes begins at 12:00:01 a.m. Central Time (CT) September 1, 2009 and ends at 11:59:59 pm (CT) on April 30, 2010 (“Promotional Period”). There are three [2] ways to enter during the promotional period:
- (1) Online Entry: Log on to www.mccanns.ie and follow the online entry instructions to be entered. Online entries must be received daily between 12:00:01a.m. (CT) and no later than 11:59:59 p.m. (CT). Only one [1] online entry per person/email address/phone number.
- (2) In-Store: To enter, complete the tear pad entry form obtained from a participating store location while supplies last. Insert completed entry form in a stamped # 10 envelope with proper postage applied and mail to: McCann’s Irish Oatmeal Body & Soul Sweepstakes, P.O. Box 2092 Grand Rapids, Minnesota 55745-2092. Only one [1] entry per person. All mail in entries must be postmarked by April 30, 2010 received by May 7, 2010. No mechanical reproductions permitted. Only one [1] entry per person for the entire promotional period, regardless of method of entry. Entries become the property of the Sponsor and will not be returned.
2. Eligibility: Sweepstakes is open to legal residents of the 50 United States and the District of Columbia at least eighteen (18) years of age or older or age of majority in their state of residence as of the date of entry into Sweepstakes. Employees of Sturm Foods, Inc, its respective parents, subsidiaries and affiliates, prize suppliers, and advertising and promotion agencies, including Marden-Kane, Inc. and its affiliates, and the immediate families (spouse, and parents, children and siblings, and their respective spouses regardless of where they live) and individuals living in the households, of the above, whether related or not, are not eligible to enter or win. Void where prohibited or restricted by law. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations.
3. Drawing: On or about May 21, 2010 a random drawing from among all eligible entries received will be conducted under the direction of Marden-Kane, Inc., an independent judging organization whose decisions are final in all matters relating to the Sweepstakes.
4. Odds: The odds of winning the grand prize depends upon the total number of eligible entries received for the Promotional Period.
5. Prize: One (1) Grand Prize: A trip for winner and guest to the Heritage Golf and Spa Resort, Killenard, County Laois, Ireland. The Prize includes:
- a) roundtrip coach air transportation from the international airport closest to winners home to Dublin, Ireland;
- b) 7 nights double occupancy accommodations;
- c) roundtrip car service in Ireland from airport to hotel;
- d) 1 full body massage per person and 1 spa experience per person e.g. mineral bath;
- e) 2 rounds of golf per person;
- f) $500 in cash (awarded in the form of a check).
Estimated Retail Value of Prize: $7,400. Actual value may vary based upon point of departure and dates of travel. No substitution, cash equivalent, or transfer of prize permitted except at the sole discretion of the Sponsor, who reserves the right to substitute a prize (or portion thereof) with one of comparable or greater value, at its sole discretion. Complete terms and conditions of trip will be furnished with prize notification.
Prize Restrictions: Blackout periods and other restrictions may apply. Winner and guest must travel together and on the same itinerary, or prize will be forfeited and, at Sponsors discretion, awarded to an alternate winner. Travel must be completed within one year of date of award or prize will be forfeited. Travel arrangements must be made through Sponsor’s agent and on a carrier of Sponsor’s choice. Reservations are subject to availability. Winner and travel companion are responsible for obtaining all travel documents including valid passports as well as travel insurance (and all other forms of insurance) that they may wish to obtain (at their own expense) and hereby acknowledges that the Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. All other expenses relating to acceptance of the grand prize that are not explicitly stated herein, including but not limited to taxes, meals, beverages of any type and gratuities are the responsibility of prize winner and guest.
6. Winner Notification: On or about May 25, 2010 the potential winner will be notified by USPS priority mail with delivery confirmation. Forfeiture of prize and the selection of an alternate winner may result from any of the following at the Sponsors’ discretion:
- [1] failure of a potential Grand Prize winner to execute and return an Affidavit of Eligibility/Liability Release, where legal, Publicity Release, and a completed IRS Form W-9 within fourteen (14) days after mailing;
- [2] the return of any notification or prize as undeliverable or
- [3] any other non-compliance with Rules. If the prize is won by a person who is 18 years of age or older, but not of the legal age of majority in the state of residence (“minor”), then the required documents listed herein must be confirmed and signed by winner’s parent or legal guardian, and the prize will be awarded in the name of his/her parent or legal guardian who will be required to fulfill all requirements imposed on the winner set forth herein.
By entering the Sweepstakes, entrants, or, if minors, their parents or legal guardians, agree to the use by Sponsors and their designees of their names and photographs/likenesses for advertising and promotional purposes for this and similar promotions, worldwide, and in perpetuity, in any and all forms of media, now known or hereafter devised (including and without limitation, the Internet) without additional compensation except where prohibited by law. Upon request, winner agrees to consent to such in writing. Guest of prize winner must be at least eighteen 18 years of age or must have reached the age of majority in his or her state of residence as of date of travel and must complete, execute and return a Travel Companion Liability Release, and where lawful, a Travel Companion Publicity Release prior to issuance of travel documents. Failure to return Travel Companion Liability & Release Forms in a timely manner may prevent travel companion from participating in the trip.
7. Limitation of Liability: By participating in the Sweepstakes, entrants agree to release, indemnify and hold harmless Sturm Foods, Inc. and its respective parent company, subsidiaries, affiliates, prize suppliers, and advertising and promotion agencies, Marden-Kane, Inc., and all its affiliates, and each of their respective agents, representatives, officers, directors, shareholders and employees (collectively, “Releasees”) from and against any injuries, losses, damages, claims, actions and any liability of any kind resulting from or arising from participation in the Sweepstakes or acceptance, possession, use, misuse or nonuse of the prize (including any travel or travel-related activity thereto) that may be awarded. Entrants agree that the laws of the state of Michigan will govern any and all disputes. Releasees are not responsible for computer, printing, typographical, human, or other errors, including, without limitation, errors which may occur in the administration of the Sweepstakes, the announcement of the prize, the processing of entries or in any Sweepstakes related materials; or for transactions that are lost, stolen, late, misdirected, damaged, incomplete, or illegible or postage due mail; fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, human or other error; or for electronic, computer, or telephonic malfunction or error, or process any transaction thereon. The use of any automated launching or entry software or any other mechanical or electronic means that permits the participant to automatically enter repeatedly is prohibited. Any entries found or suspected to be submitted in this manner will be deemed ‘void’ by the judges.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
If in the Sponsor's opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Sweepstakes, the judges reserve the right at their sole discretion to disqualify any individual who tampers with the entry process and or void any entries submitted fraudulently, to modify or suspend the Sweepstakes, or to terminate the Sweepstakes and conduct a random drawing to award the prizes using all eligible non-suspect online and write-in entries received as of the termination date. As a condition of entering the Sweepstakes, participant agrees that:
- a.) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses;
- b.) all causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action; and
- c.) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys fees. Sponsor reserves the right to modify prize award procedures.
In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be deemed made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. If entering via online entry method entrants are subject to the terms set forth in the Sturm Foods Privacy Policy (www.sturmfoods.com/privacy.html).
8. Who Won?: For the name of the winner (available after June 30, 2010), mail a self-addressed, stamped envelope to: McCann’s Irish Oatmeal Body & Soul Sweepstakes Winner, P.O. Box 701, Sayreville, NJ 08871-0701. Requests must be received no later than August 31, 2010. Requests will be fulfilled when the drawing has been conducted and winner has been verified.
